Fairfax County is devoted to protecting the rights of all residents, regardless of their immigration or citizenship status. While Fairfax County Public Library staff cannot provide legal advice, this guide highlights the most relevant county, state, and national resources.

Library Privacy and Confidentiality

Confidentiality of Customer Records

Effective July 1, 2021, any contact information provided to Fairfax County by an individual for “the purpose of receiving electronic communications from the public body” is protected from release under VFOIA Code Section 2.2-3705.7.

  • Library Account Records of Children - the library's Board of Trustees has approved a policy that current library records of children 12 and under should be available to their parents or guardians. Parents of children age 12 and under may ask for and obtain the titles of materials that their children currently have checked out. Records of cardholders, age 13-18, are confidential, as are adult records.

  • Privacy Policy of Third-Party Vendors and Amazon - if you use third party vendors, such as Overdrive, to access library materials, your records may be subject to the policies of that vendor. The majority of the Fairfax County Public Library's eBooks and eAudiobooks are accessed through Overdrive. Kindle users are subject to the privacy policies of Amazon.com when they access their Amazon.com accounts. Please visit individual vendor sites for more information.

Staff shall not provide records or information to any individual or agency unless ordered by a court of competent jurisdiction.

Virginia Freedom of Information Act

According to sub-section 3 of Virginia state law § 2.2-3705.7., commonly known as the Virginia Freedom of Information Act, library records are inherently excluded from mandatory disclosure to the public. In accordance with this law, staff shall not provide records or information to any individual or agency unless ordered by a court of competent jurisdiction.

You may choose to waive this right for your Fairfax County Public Library account under the "FOIA Opt-Out" option. Selecting “YES” indicates your agreement to keep your data private under this law. Selecting “NO” indicates your consent to allow your data be searchable by the public.
